Castine Resident Fitness Center Membership

In consideration of my use of the exercise equipment and facilities provided by the company, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that Maine Maritime Academy and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from negligence of the company. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge Maine Maritime Academy, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present and future, whether the same be known or unknown, anticipated, or unanticipated, resulting or arising out of the use of said equipment and facilities.

I expressly agree to indemnify and hold Maine Maritime Academy harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me or my guest.

I agree to be solely responsible for safety and well-being of my guest and myself. I understand that Maine Maritime Academy does not provide supervision, instruction, or assistance for the use of the facilities and equipment.

I agree to comply with all rules imposed by Maine Maritime Academy regarding the use of the facilities and equipment.

I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and acknowledge that the use of the exercise equipment involves risk of serious injury, including permanent disability and death.

I understand and agree that Maine Maritime Academy is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, and that my use of the facilities and equipment is not within the course or scope of my employment.

Electronic Signatures: Each party agrees that this Agreement and any other documents to be delivered in connection herewith may be electronically signed, and that any electronic signatures appearing on this Agreement or such other documents are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.

The Cardio Room, Fitness Studio, Weight Room, Bok Pool and men's and women's public locker rooms are open to students, staff and paying members who are 16 years old and above only. Any user under 16 must be a paid member accompanied by an adult member.

Persons using the fitness center do so at their own risk. The Academy shall not be liable for any loss or damage to property or any bodily injuries, illness or death of any student, member and/or any other persons including third parties howsoever caused arising directly or indirectly out of or in any way connected with the exercise of fitness center membership benefits, use of the fitness center or participation in any program, and/or use of equipment. This shall be effective save when expressly excluded by applicable law.

Persons using the equipment in the fitness center are responsible for their own safety. You should consult a physician prior to beginning a fitness program.

The Academy reserves the right to suspend the use of any facilities at any time for the organization of private classes and activities or for the arrangement of maintenance or cleaning without prior notice.


GENERAL RULES AND REGULATIONS

* All users must be able to present an active ID on demand. The Academy reserves the right to revoke any membership if users are caught bringing non-member guests.
* Please use earbuds. Use of any speakers or amplifiers is prohibited.
* Please use appropriate language in the fitness center. Use of profanity, racist, sexist, misogynistic and/or homophobic/transphobic language is/are prohibited.
* Spray and wipe down all equipment when you are finished your use, regardless of how long you used the equipment.
* Private coaching, assessments and other related activities are not allowed in all venues without prior authorization from the Academy.
* Please handle the equipment in the fitness center with care. Users are responsible for any damages to the facilities or equipment.
* All users are required to follow the instructions of the Academy staff.
* The Academy reserves the right to amend these rules and regulations without prior notice.
* For the safety of all users, please refrain from preventing or interfering others’ use of the equipment in the Gymnasium.
* For the benefit of al users, return equipment to its place after use. Rack all weights.
* Do not hang jackets, hats, or other apparel on equipment. Use the public locker rooms for stowing your personal items.
* Except for Academy’s activities, no commercial activities are allowed in the fitness center without prior approval from the Academy.
* The Academy will take no responsibility for the loss, theft or damage of belongings brought into the fitness center by users.


DRESS CODE

All users should wear appropriate apparel and footwear to comply with the requirements of the fitness center, otherwise the access to and use of such facilities will be refused. Your outdoor shoes carry salt, sand, and other debris into the building. Change into clean shoes prior to use of any equipment or fitness center spaces.

By checking the box above, you authorize Maine Maritime Academy to withdraw payment for the amount indicated above from your account on a monthly basis until such time that you cancel your membership. You represent that you have the authority to withdraw funds from the deposit account selected. Because this is an electronic transaction (also called an ACH transaction), the payment funds will be withdrawn from your account within two business days from the date of payment.
